EGBA, the European Gaming & Betting Association, has stated in a press release that the European Commission has issued a ‘detailed opinion’ against the draft German State Gambling Treaty. Accordig to this detailed opinion, Commission believes that the proposed German State Treaty breaches the EU law. Unless the draft is changed substantially after this warning, Germany risks formal infringement proceedings, referral to the European Court of Justice (CJEU) and ultimately financial penalties.
The Commission objects that while the draft law appears to open the market for online sports betting operators from all EU member states,in practice it reserves the market for the incumbent German monopolies.
